From time to time, we may change this Privacy Notice. If we do, we will post an amended version on this webpage with a new "Last Updated" date. If we make material changes, we will provide you with additional notice, such as adding a statement on the homepage of our Site or sending you an email notification. Please review this Privacy Notice periodically.

  • Third-Party Data Providers. We obtain property owner contact information, property enrichment data, and mailing address verification data from third-party data providers and data brokers.

  • Public Records. We collect property ownership information, tax parcel data, and property characteristics from county tax assessor offices and other government entities.

  • Mapping and Geographic Data Providers. We obtain lake location data, geographic boundaries, and water body information from USGS and other geographic data sources.

In addition to the purposes stated above, we may use all the personal data we collect in accordance with applicable law to:

  • Provide, maintain, and improve our Site and Services;

  • Process your subscription payments and manage your account;

  • Fulfill your direct mail campaign orders through our third-party service providers;

  • Provide customer support and respond to your inquiries;

  • Send you transactional communications, including account updates, billing notifications, direct mail campaign confirmations, and service announcements;

  • Send you marketing communications about our Services (with your consent where required by law);

  • Direct Mail Service Providers. When you use our direct mail services, we share recipient names, mailing addresses, and mailing content with our direct mail fulfillment partner to process and deliver your mailings.

  • Payment Processors. We share payment information with third-party payment processors to process your subscription payments and activity-based fees.

  • As Required by Law. To the extent that we are required to do so by law, court order, subpoena, or other legal process.

  • Legal Proceedings. In connection with any legal proceedings or prospective legal proceedings.

  • To Protect Rights. To establish, exercise, or defend our or a third party's legal rights, including providing information to others for the purposes of fraud prevention.

  • Business Transactions. With any person or entity as part of any business or asset sale, equity transaction, merger, acquisition, bankruptcy, liquidation, or similar proceeding, or in preparation for any of these events, and that person or entity may use your personal data for their own purposes.

  • Other Purposes. For any other purpose disclosed by us when you provide the personal data or for any other purpose we deem necessary, including to protect the health or safety of others.


  1. COOKIES AND OTHER TRACKING TECHNOLOGIES

How We Use Cookies

Like many other companies, we use cookies and other tracking technologies (collectively, "Cookies"). Cookies are small files of information that are stored by your web browser software on your computer hard drive, mobile or other devices (e.g., smartphones or tablets).

We use Cookies to:

  • Estimate audience size and usage patterns;

  • Understand and save your preferences for future visits, allowing us to customize the Site and Services to your individual needs;

  • Keep track of search queries and property searches;

  • Compile aggregate data about site traffic and site interactions to resolve issues and offer better site experiences and tools in the future; and

We set some Cookies ourselves, while separate entities set other Cookies. We use Cookies other entities set to provide us with useful information, to help us improve our Site and Services, to conduct advertising, and to analyze the effectiveness of advertising.

  1. OPT-OUT PREFERENCE SIGNALS

We do not engage in "sales" or "shares" or "targeted advertising" as those terms are defined under applicable state privacy laws, and therefore our Site does not recognize the Global Privacy Control ("GPC") signal. If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use.

Some internet browsers incorporate a "Do Not Track" feature that signals to websites you visit that you do not want to have your online activity tracked.ย 

Given that there is not a uniform way that browsers communicate the "Do Not Track" signal, the Site does not currently interpret, respond to, or alter its practices when it receives "Do Not Track" signals.

We maintain commercially reasonable security measures to protect the personal data we collect and store from loss, misuse, destruction, or unauthorized access. However, no security measure or modality of data transmission over the Internet is 100% secure. Although we strive to use commercially acceptable means to protect your personal data, we cannot guarantee absolute security.

We retain your personal data for as long as necessary to fulfill the purposes for which we collect it, such as to provide you with the Services you have requested, and for the purpose of satisfying any legal, accounting, contractual, or reporting requirements that apply to us.

Specifically, we retain:

  • Account Information for the duration of your subscription plus seven (7) years after account closure for accounting and legal compliance purposes.

  • Payment Information in accordance with our payment processor's retention policies and applicable financial recordkeeping requirements.

  • Direct Mail Campaign Records for seven (7) years to comply with marketing compliance and recordkeeping obligations.

  • Usage and Analytics Data for up to two (2) years.

The Site may contain links that will let you leave the Site and access another website. Linked websites are not under our control. We accept no responsibility or liability for these other websites.

  1. CHILDREN'S PRIVACY

The Site and Services are not intended for children under 13 years of age. We do not knowingly collect, use, or disclose personal data from children under 13.

  1. NOTICE TO NEVADA RESIDENTS

Nevada law allows Nevada residents to opt out of the sale of certain types of personal information. We do not currently sell personal information as defined in Nevada law. However, if you are a Nevada resident, you may submit a verified request to opt out of sales and we will record your instructions and incorporate them in the future if our policy changes.   1. NOTICE TO CALIFORNIA RESIDENTS

The California Consumer Privacy Act, as amended by the California Privacy Rights Act of 2020 ("CCPA"), requires that we provide California residents with a privacy notice that contains a comprehensive description of our online and offline practices regarding the collection, use, disclosure, sale, sharing, and retention of personal information and of the rights of California residents regarding their personal information. This section of the Privacy Notice is intended solely for, and is applicable only as to, California residents. If you are not a California resident, this section does not apply to you and you should not rely on it.

We currently collect and, in the 12 months prior to the Last Updated Date of this Privacy Notice, have collected the following categories of Personal Information:

  • Identifiers (name, email address, postal address, phone number, IP address, account name, unique device identifiers, subscription ID)

  • Personal information described in California's Customer Records statute (name, address, telephone number, credit card number, bank account number)

  • Commercial information (subscription plan details, direct mail campaign records, property searches conducted, data export history, purchasing history)

  • Internet or other electronic network activity information (browsing history, search history, information regarding interaction with our Site)

  • Geolocation data (general location derived from IP address)

  • Inferences (preferences related to lake properties, marketing interests, property types of interest)

We collect Personal Information directly from California residents and from third-party data providers, county government entities, public records sources, mapping data providers, and payment processors.

How We Use Personal Information

In addition to the purposes stated above in the section "HOW WE USE YOUR PERSONAL DATA," we currently collect and have collected the above categories of Personal Information for the following business or commercial purposes:

  • Performing services, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing analytic services, or providing similar services;

  • Providing advertising and marketing services;

  • Helping to ensure security and integrity to the extent the use of your Personal Information is reasonably necessary and proportionate for these purposes;

  • Debugging to identify and repair errors that impair existing intended functionality;

We disclosed Personal Information for the following business purposes: to provide our Services, process payments, fulfill direct mail orders, provide customer support, analyze Site usage, and maintain our Site.

We have not sold or shared Personal Information in the twelve (12) months preceding the Last Updated Date of this Privacy Notice. We do not knowingly sell or share the Personal Information of consumers under 16 years of age. We do not use sensitive Personal Information for purposes other than those allowed by the CCPA and its regulations.

Shine the Light Law

We do not disclose personal information obtained through our Site or Services to third parties for their direct marketing purposes. Accordingly, we have no obligations under California Civil Code ยง 1798.83.
